Waste Removal Hampstead Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Removal Hampstead provides waste removal and related services. By booking a collection or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person or business placing a booking for waste removal services with Waste Removal Hampstead.

Services means the waste collection, removal, loading, transportation, disposal, recycling, and any related services provided by Waste Removal Hampstead.

Waste means any items, materials, rubbish, junk, or refuse presented by the Customer for collection and removal as part of the Services, subject to applicable regulations.

Contract means the legally binding agreement between Waste Removal Hampstead and the Customer comprising these Terms and Conditions and the confirmed booking details.

2. Scope of Services

Waste Removal Hampstead provides waste collection and removal services for domestic and commercial customers, including but not limited to household waste, bulky items, garden waste, light construction debris, and general rubbish clearances. The exact scope of each service will be as described in the booking confirmation.

We reserve the right to refuse to collect certain items or materials that are hazardous, prohibited by law, unsafe for collection, or unsuitable for our vehicles and staff. This may include, without limitation, asbestos, chemicals, solvents, batteries, clinical waste, gas cylinders, and any item deemed dangerous or non-compliant with applicable waste regulations.

3. Booking Process

3.1 Bookings can be made by telephone or through our designated booking channels as notified from time to time. When placing a booking, the Customer must provide accurate and complete information, including the type and approximate volume or weight of waste, the collection address, access details, and any relevant restrictions such as parking or loading constraints.

3.2 All bookings are subject to availability and to acceptance by Waste Removal Hampstead. We are not obliged to accept every booking request. A Contract is formed only when we confirm the booking and provide the scheduled collection date and time window.

3.3 The Customer is responsible for ensuring that any information provided at the time of booking is correct. If the actual waste presented for collection materially differs from the description provided, we may adjust the price, amend the service offered, or decline to complete the collection.

3.4 Any timescales or time windows provided for collection are estimates only. While we will use reasonable efforts to attend within the agreed window, service times may vary due to traffic, access, vehicle availability, or operational constraints.

4. Access and Customer Responsibilities

4.1 The Customer must ensure that our collection team has safe, reasonable, and lawful access to the premises and the waste to be removed, including any necessary access codes, permits, or arrangements with building managers or neighbours.

4.2 The Customer is responsible for ensuring that the waste to be collected is clearly identified and separated from any items that should not be removed. We will not be liable for removing items that have been incorrectly presented or mixed with waste, where a reasonable person would assume they were intended for disposal.

4.3 The Customer must ensure that the access route and collection area are free from hazards and that our team can safely load the waste onto our vehicle. We reserve the right to refuse or suspend Services where we consider that health and safety might be compromised.

4.4 Where required, the Customer must arrange suitable parking or loading space for our vehicles. Any parking charges, fines, or penalties incurred as a result of insufficient arrangements or information provided by the Customer may be charged to the Customer.

5. Pricing and Quotations

5.1 Our charges are generally based on the volume and type of waste collected, as well as any additional services such as labour time, dismantling, or special handling requirements. Indicative prices or quotes provided prior to collection are estimates only and may be adjusted once our team has inspected the waste.

5.2 The final price for the Services will be confirmed on site before loading, once the waste has been assessed. If the Customer does not accept the revised price, we reserve the right not to proceed with the collection. In such cases, a call-out or attendance fee may be charged, where notified in advance.

5.3 All prices are stated in pounds sterling and may be subject to applicable taxes or charges as required by law. We reserve the right to change our pricing at any time, but such changes will not affect any bookings already confirmed.

6. Payments

6.1 Payment is due at the time of collection unless otherwise agreed in writing. We may accept payment by cash, card, bank transfer, or other methods that we notify to the Customer.

6.2 For commercial Customers, credit terms may be offered at our discretion, subject to a separate credit agreement. Invoices are payable within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

6.3 If the Customer fails to make payment on time, we may charge interest on the overdue amount at the statutory rate applicable to commercial debts, and we may suspend or cancel any further Services until payment is received in full.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting us during our normal business hours. Cancellations or amendments are not effective until confirmed by us.

7.2 If the Customer cancels a booking more than 24 hours before the scheduled collection time, no cancellation charge will normally apply. If cancellation occurs within 24 hours of the scheduled collection time, we reserve the right to charge a late cancellation fee to cover our costs and loss of opportunity.

7.3 If our team attends the site at the agreed time and is unable to carry out the Services due to the Customer’s act, omission, or failure to provide access or accurate information, we may charge a wasted journey or call-out fee, and any rebooked collection will be treated as a new booking.

7.4 We may cancel or reschedule a booking at any time where we are unable to provide the Services due to events beyond our reasonable control, including but not limited to vehicle breakdown, staff illness, severe weather, or legal or regulatory restrictions. In such cases, we will notify the Customer as soon as reasonably practicable and offer a revised collection time.

8. Waste Regulations and Compliance

8.1 Waste Removal Hampstead operates in accordance with applicable UK waste management legislation and duty of care requirements. Waste is transported and disposed of only at licensed or authorised facilities and, where reasonably practicable, is recycled or recovered.

8.2 The Customer warrants that all waste presented for collection is lawful and that the Customer has the right to dispose of it. The Customer must not present stolen goods or items that infringe any third party rights.

8.3 The Customer must not present hazardous or prohibited waste unless specifically agreed with us in advance and where lawful for us to collect. If such items are discovered during or after collection, we may charge additional fees for safe handling and disposal or may refuse to take such items. We also reserve the right to report unlawful waste activities to the relevant authorities.

8.4 Where required by law, we will provide a waste transfer note or any similar documentation. The Customer must provide all information reasonably necessary to complete such documentation, including an accurate description of the waste.

9. Liability and Insurance

9.1 We will provide the Services with reasonable care and skill. If we fail to do so, we may, at our option, re-perform the Services or offer an appropriate price reduction where re-performance is not reasonably possible.

9.2 Our liability for any loss or damage arising from or in connection with the Services is limited to the amount paid or payable by the Customer for the specific booking giving rise to the claim. Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded by law.

9.3 We will not be liable for any indirect, consequential, or economic loss, including but not limited to loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the Services or these Terms and Conditions.

9.4 The Customer is responsible for removing or protecting any property that might be damaged during the clearance process, such as floor coverings, decorations, or fragile items. While our team will take reasonable care, we are not liable for wear and tear or minor damage that is reasonably incidental to the normal performance of waste removal services.

9.5 We maintain appropriate insurance cover for our operations. Copies of our insurance details are available on request.

10. Customer Property and Left Items

10.1 The Customer is responsible for ensuring that no personal or valuable items are left in or attached to waste intended for collection. Our team is not required to check bags, boxes, or containers for personal items.

10.2 Once the waste has been loaded onto our vehicle, ownership of the waste transfers to Waste Removal Hampstead, subject to applicable waste regulations. We are not obliged to retrieve items that the Customer later claims were removed in error.

11. Data Protection and Privacy

11.1 We collect and process personal data such as contact details and service information for the purposes of administering bookings, providing Services, handling payments, and managing customer relationships.

11.2 We will take reasonable steps to keep such personal data secure and to use it only for lawful purposes related to our waste removal services, compliance with legal obligations, or legitimate business interests.

11.3 The Customer has certain rights in relation to personal data under applicable data protection laws, which may include the right to access, correct, or request deletion of personal information, subject to legal limitations.

12. Complaints and Dispute Resolution

12.1 If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible with details of the issue. We will investigate and respond within a reasonable timeframe.

12.2 We aim to resolve complaints amicably through communication with the Customer. If a dispute cannot be resolved informally, the parties may consider mediation or other forms of alternative dispute resolution, without prejudice to either party’s right to commence legal proceedings.

13. Force Majeure

13.1 We are not liable for any failure or delay in performing our obligations under the Contract where such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, adverse weather, strikes, lockouts, industrial disputes, war, civil unrest, pandemic, government restrictions, or interruption of utilities or transport networks.

13.2 If a force majeure event continues for a prolonged period, we may terminate the affected Contract without liability, after notifying the Customer.

14. Termination

14.1 We may terminate the Contract immediately by notice in writing if the Customer commits a material breach of these Terms and Conditions or if we reasonably suspect fraudulent or unlawful activity.

14.2 Termination shall not affect any rights or obligations that have accrued prior to the date of termination, including the obligation to pay for Services already provided.

15. Variations to Terms

15.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to that Contract.

15.2 Any variation to these Terms and Conditions requested by the Customer will only be valid if agreed in writing by an authorised representative of Waste Removal Hampstead.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, including any non-contractual disputes or claims.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

17.2 No failure or delay by Waste Removal Hampstead in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy, nor shall it prevent any future exercise of it.

17.3 The Customer may not assign, transfer, or subcontract any of their rights or obligations under the Contract without our prior written consent. We may transfer our rights and obligations under the Contract where reasonably necessary for business operations, provided that this does not materially affect the Customer’s rights.

17.4 These Terms and Conditions, together with the confirmed booking details, constitute the entire agreement between the parties in relation to the Services and supersede any prior understandings or representations, whether written or oral.
